How long does conveyancing take?

The length of time taken to complete a conveyancing transaction depends on several factors, in particular the other parties in the chain. We always work to eliminate unnecessary delays on our part and to chase up our clients’ buyers and sellers wherever possible.

If your transaction is part of a lengthy chain, then the conveyancing may take several months. Issues that can slow a sale or purchase down include legal issues with the title, waiting for search results, problems revealed in a survey and delays in receiving a mortgage offer. On average, most conveyancing is completed within 8-12 weeks.

What does conveyancing involve?

If you are buying a property, then the first step to take when you have an offer accepted is to contact a solicitor and ask them to represent you. In fact, you can do this even before you have found a property so that you have someone lined up to start work straight away.

If you ask us to act for you, we will send you the preliminary forms to be completed and also carry out the necessary identity checks. The seller’s solicitor will send us the contract package which will contain information about the property, including a copy of the legal title, a property information form and a list of the fixtures and fittings that are included in the sale.

We will apply for searches and go through the legal documentation, raising enquiries with the seller and their solicitor as appropriate.

Once we have all of the information we need, we will report to you and you can sign the contract in readiness for exchange. Your mortgage lender will send us a copy of your mortgage offer and we will provide you with the mortgage deed for signature.

You will also need to let us have your deposit for payment on exchange. This is often 10% of the purchase price, but if you are also selling a property, it is usually possible to use the deposit from your sale.

We will discuss potential completion dates with you and once we have agreed on a date, we can exchange contracts. This is the point at which the transaction becomes legally binding and the completion date is settled. Following exchange, we will carry out the pre-completion searches and order your mortgage advance. You will need to arrange to send us the balance of completion money, if any is needed, in readiness.

On the day of completion, we will arrange for the money to be sent to the seller’s solicitor and once it has been received, they will authorise the estate agent to release the keys to your new home to you.

Following completion, we will arrange for the property and any mortgage to be registered into your name at HM Land Registry.
