If you have found a property to buy, then you should contact a solicitor to ask them to represent you. You can then give their name to the estate agent dealing with the transaction and they will be able to pass the details on to the sellers’ solicitor.
If you are selling a property, then ideally you should speak to a solicitor as soon as possible so that they can do some of the preliminary work involved such as setting up a file and letting you have property information and fixtures and fittings forms to complete om readiness for when a buyer is found.
Once all buyers and sellers in a chain are in place, then your solicitor will be able to start work.
If you are selling a property, then your solicitor will obtain your title deeds and prepare a contract package for the buyer’s solicitor.
If you are buying a property, then your solicitor will apply for searches once they have received the contract papers. They will go through all of the information provided and make enquiries of the seller and their solicitor on all the points that need answering.
Once your solicitor has replies to these enquiries, search results and your mortgage offer, they will be ready to exchange contracts.
If you are buying, you will usually need to provide a deposit of 10% in readiness for exchange. You will agree on a completion date and this will be written into the contract on exchange. Once contracts are exchanged, the sale or purchase agreement becomes legally binding.
Your solicitor will then carry out the final pre-completion searches and order your mortgage advance in readiness for the purchase. On completion day, once the money has been received by the seller’s solicitor, the estate agent will be authorised to release the keys to you.
After the completion of a sale, your solicitor will arrange for the discharge of your mortgage and send the transfer document and title deeds to the buyer’s solicitor. If you are the buyer, then your solicitor will register your purchase and mortgage at HM Land Registry on your behalf.
The time taken to complete a property sale or purchase can vary widely. If a long chain is involved, then a transaction may move slowly as it will only proceed at the pace of the slowest link. A sale or purchase can take between 8 and 12 weeks to complete.
Issues that may cause delays include slow search results, a delay in the issuing of a mortgage offer or a legal difficulty or problem revealed in a survey. An experienced solicitor will be able to stay on top of a transaction from the start, spotting any potential delays early on and staying in close contact with other parties to try and speed matters up.
It is always recommended that you have a survey carried out if you buy a property. There are different types of survey available, depending on the condition of the property and what you intend to do with it. For example, if the property is in reasonable condition, a level 2 survey, sometimes called a homebuyer survey may be sufficient.
If the property is modern, in good condition and you do not intend to carry out works, you could consider a level 1 survey, also called a condition report. If you are buying a property that is more than 50 years old, that is in poor condition or of an unusual design, you are usually advised to obtain a structural or level 3 survey. This may also be recommended if you are intending to renovate.
